(a) “Account” means your Waiwai user account which you must register for through the Site in order to use the Service. (b) “Applicable Law” means any and all applicable federal, state and local laws, statutes, ordinances, regulations, rules, opinions, interpretive letters and other official releases of or by any government, or any authority, department or agency thereof which are now in effect or which may come in to effect during the period in which you use the Services. (c) “Privacy Policy” means this statement of our information privacy practices, policies and procedures, as may be amended from time to time. (d) “Waiwai”, “we” “our” or “us” shall mean Purple Maiʻa Foundation, a Hawaii non-profit corporation. (e) “Personal Information” includes all information you enter into the Waiwai site or mobile- device application and any information Waiwai obtains about you or your accounts or account activity to support the functions you authorize, such as bill payment. Personal Information may include your name, your date of birth, your social security number, your tax identification number (if applicable), your home or other physical address, your email address, your telephone number, banking information, information concerning your financial goals and preferences, and other information that identifies you or may be associated with you. (f) “Service” means the Waiwai interactive platform, and all associated functions performed by Waiwai, that assists you with establishing personal savings goals and making contributions to those goals by (i) tracking your account, (ii) providing personalized and automated savings advice, (iii) notifying you of savings opportunities, or (iv) automatically moving money to your Waiwai Account based on your settings. (g) “Site” means our website located at waiwaifinance.comweb application located at www.waiwai.community or mobile-device based application you access and operate from your mobile device or computer or phone. (h) “You,” “your,” and “User” means the person or entity using or accessing the Site or Service under this Agreement.

3. INFORMATION WE COLLECT ABOUT YOU.
3.1 Personal Information.
When you register your Account, you will be required to provide certain Personal Information to us in order to create an Account and make use of the Services. When you use the Waiwai Service, we collect information about you and your account activity. We do not collect Personal Information from you unless you voluntarily provide Personal Information during Registration or when you otherwise access or make use of the Service. By providing your Personal Information to Waiwai, you expressly agree to our collection, use, and disclosure of such information as described in this Privacy Policy. We will use Personal Information to confirm your identity as required by certain laws governing Waiwai.
3.2 Account Information.
When you register with Waiwai and request a new bank account or debit card, Waiwai will open on your behalf a bank account with our Partner Bank (“Connected Bank Account”) and an investment account with our partner Investment Custodian (“Investment Account”), as described more fully in Terms of Use. Waiwai will obtain and use information about your Connected Bank Account and Investment Account to provide the Waiwai Services, including your log-in credentials, password, account number, routing number, other user information and account activity, and your eligibility for such accounts based on background checks operated by the associated institutions. All such information is referred to as “Account Information.” You agree and accept that Waiwai may collect, use, and retain all such Account Information as part of your Personal Information. In addition, if you use services that may be available through Waiwai to transfer funds to or from external accounts at financial institutions to or from your Connected Bank Account, Waiwai may obtain information related such external accounts, such as account numbers and balances and other account attributes.
3.3 Waiwai use of Third-Party Service Providers.
Waiwai contracts with third parties to access all accounts associated with your Waiwai account, including the Bank Account and Investment Account and external accounts using the Account Credentials that you provide to us. By providing us with your Account Credentials, you authorize Waiwai and its third-party providers to use your Account Credentials to access your Funding Account only as may be necessary to provide the Service to you according to your Settings.
3.4 Information from Third-Party Sites.
In order to display information to you or facilitate your access and use of the Service, we may collect, on your behalf, your account and other Personal Information from third party websites that you register under your account via the Service.
3.5 Technical and Navigational Information.
We may collect your computer browser type, Internet protocol address, pages visited, location preferences, identification numbers associated with your personal devices, date and time stamps of transactions, average time spent on our Site, and other interactions with the Services. This information may be used, for example, to alert you to software compatibility issues, or it may be analyzed to improve our web design and functionality.
4. Our Use of Your Personal Information.
We may use the Personal Information you provide to us as necessary (i) to provide the Services to you according to your Settings, (ii) to respond to your inquiries about or provide you with updates regarding our Services, and (iii) to offer you other products, services, or offerings that we believe may be of interest to you. We may provide your Personal Information to our third party service providers in order to complete funds transfers or investment decisions you request in your Settings, to verify the existence and condition of your Funding Account, or to otherwise assist with a funds transfer or the investment of funds. We may use your Personal Information to improve and personalize the Services and any related services, including future products and services.
5. How We Share Your Personal Information.
We may share Personal Information about you as follows: (a) We will share information about you with our third-party service providers as necessary to provide the Services to you. (b) In connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture, or dissolution of all or a portion of our business; (c) To deliver to you any administrative notices, money alerts and communications relevant to your use of the Service; (d) To respond to subpoenas, court orders, or legal process; (e) To improve our website, web app, mobile app, or the Services; (f) In order to investigate, prevent, defend against, or take other action regarding violations of our Terms of Use, illegal activities, suspected fraud, or situations involving potential threats to the legal rights or physical safety of any person or the security of our Site or Services; (g) Non-personalized, anonymous data may be aggregated with data from other users and other data sources and may be collected and shared with partners or for marketing purposes; (h) To respond to claims that any posting or other content violates the rights of third parties; (i) In an emergency, to protect the health and safety of our Site’s users or the general public; or (j) As otherwise required by Applicable Law.
6. Notifications.
Waiwai sends Waiwai users messages through various channels such as emails, texts, and may include other electronic or paper-based channels. Receipt of these messages may indicate you are a Waiwai user. You agree and accept that Waiwai may use the contract information you provide to Waiwai to send you such notifications.
7. “Do Not Track (DNT)” Browser Signals.Do Not Track (“DNT”) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and third parties. Waiwai does not recognize or take any automated action in response to browser “do not track” signals.
8. Social Media Platforms and Websites.
8.1. Any information, communications, or material of any type or nature that you submit to our Site or Service through the use of social media integration (including, but not limited to any of our websites or profiles contained on a social media platform or website such as Facebook or Twitter) by email, posting, messaging, uploading, downloading, or otherwise (collectively, a “Submission”), is done at your own risk and without any expectation of privacy. We cannot control the actions of other users of any social media platform or website and we are therefore not responsible for any content or submissions contained on such sites and platforms.
